Party's obligation in the implementation of the project

Government:

  • Facilitate and coordinate with relevant competent line-ministries and institutions as well as other local competent authorities to facilitate the company;
  • Review and approve or make amendment on the master plan within the period of not later than one month after receiving the master plan from the company
  • Provide interventions to the relevant institutions in order to solve the problems encountered and those who commit offense and violate the rights of company in relation of the contract implementation and location use or land grabbing of any part of the location

Company:

  • A master plan indicating land utilization on concession land, location of planting areas etc. shall be completely prepared within the period of not later than three months after obtaining the concession land and this master plan shall be submitted to government for review and approval
  • Take responsibilities to bear all capital expenses for the investment project in terms of the development and use of economic concession land, including the expenses for fulfillment of the duties as stipulated.
  • Strictly respect to the laws and regulations in forced.
  • Use the local labor force
  • Pay taxes in accordance with the laws and regulations imposed
  • Pay deposit and fees according the Article 9 of this contract until the termination
  • Focusing on the livelihood, health and education of its employee
  • Implementing business activities as planned Operating business production
  • Allowing the ministry and relevant institutions to monitor and evaluate its activities.
  • Report to the ministry, the achievement of the implementation of the investment works.
Job creation summary

Use the local labor force. In the event that Khmer experts are unavailable, the company has the rights to hire foreign experts to advise and instruct on technical issues related to the business production as needed and this shall be following the laws and regulations of the Kingdom of Cambodia.

Environmental protection obligation
  • Before clearing the land for planting, the investor shall request permission from government. For the logs obtained from land clearance, the investor shall collect and keep in specific area and report to the government so as for the public procurement or for royalty and fee payment in accordance with the principles and Forestry Law in effect.

  • Bear responsibility for the protection and conservation of evergreen forest semi, evergreen forest, and deciduous forest where existed in the conserved and protected locations inside the concession land.

Socio-cultural protection
  • All constructions of infrastructure, such as dams and canals that may affect to the people and surrounding areas, shall be permitted by government and/or relevant and concerned institutions.
  • Secure people who are living in the investment zone to get proper benefit from the investment project, such as the use of infrastructure, road, school, health center and the creation of job opportunity linking with the investment project, including the integration of household farmers’ production.
  • Consider in improving the livelihood as well as health and education to its employees; workers and their families by building the suitable houses, hospitals, temples, schools and recreation centers.
Suspension and/or revocation or termination

Suspension of the contract:

  • In the event that the investor fails to fulfill any terms and conditions stipulated in the contract has plan or Environmental and Social Impact Assessment (ESIA) reports;
  • Disputes occurred with the local people or the third parties related to the right of land tenures in parts of the concession land;
  • Legally mining activities that to be considered high economic potentials.

Termination of the contract:

  • Following the contract duration which stipulated in the contract;
  • Agreement of both parties;
  • Confiscation of concession land followed by administrative decision; The government shall unilaterally confiscate the economic concession land from the investor without any compensation in any case that investor
